This Yamaha Motor Group U.S. Privacy Policy (“U.S. Privacy Policy”) informs you of the methods taken by Yamaha Motor Co., Ltd. and its group companies (collectively, the “Group” or “we”) to process personal information of our consumers. This U.S. Privacy Policy supplements our global privacy policy [ link ]. (“Global Privacy Policy”) and prevails over any conflicting provisions in the Global Privacy Policy.
In addition to, or separately from this U.S. Privacy Policy, some companies, products, and services of the Group may establish individual privacy policies that inform customers about detailed information in relation to the processing of customers’ personal information. When there are any discrepancies between this U.S. Privacy Policy and any of those individual privacy policies, that individual privacy policy will prevail.

* Personal Information does not include publicly available information from government records, deidentified or aggregate consumer information, and personal information protected by certain other sector-specific federal or state statutes.
*Consumer’s precise geolocation means any data that is derived from a device and that is used or intended to be used to locate a consumer within a geographic area that is equal to or less than the area of a circle with a radius of 1,850 feet.
2. Purpose of use of personal information
Your personal information collected will be used for the following purposes:
- For providing Group products and services, including supplemental and related services. (Depending on the service and/or product, location and vehicle information may be collected).
- Ensure smooth facilitation of a product or service which may involve sharing of your personal data within the Group.
- For collecting and conducting data analysis of market information for purposes of research, development and improvement of the quality and variety of our Group products and services.
- For responding to inquiries, requests and complaints.
- For sharing marketing information on new and existing Group products and services, and invites to events and campaigns held in association with our Group.
- For fulfilling contractual obligations.
- For responding to data rights requests.
- For ensuring protection and safety of property and rights.
- For establishing, exercising, or defending against legal claim.
- For protecting network and information asset (such as by access control and log acquisitions).
- For compliance with applicable laws and regulations.

3. Disclosure of your personal information with third parties

* “Sell” means disclosing consumer’s personal information by the business to another business or a third party for monetary or other valuable consideration.
4. Cookies and the use of cross-context behavioral advertising
The Group’s websites and applications (the “Applications”) may use cookies, web beacons, and other similar technologies. These enable us to provide you with an enhanced experience when you use the Applications and allow us to improve the Applications.
Within the preceding 12 months, we have shared* personal information to the following categories of third parties—online advertising service providers such as Google LLC, Yahoo Japan Corporation, Meta Platforms, Inc. etc.

5. Transfer of personal information abroad
As we engage in business activities on a global scale, we may transfer your personal information to a country or region that do not have privacy laws or regulations equivalent to the country or region you reside in or are located. When transferring your data abroad, we will take appropriate measures in accordance with provisions set forth in applicable laws and regulations.
6. Retention period
We will store your personal information for the period necessary to fulfill the stated purposes of use and as required by applicable laws and regulations.
7. Your rights
We recognize you have certain rights to your personal information under the applicable state law, including rights to know, access, correct, transfer, restrict, object (opt-out), portability and/or deletion of your information. The scope and applicability may depend on the applicable law. Verifiable Request
As required under applicable law, we take steps to verify your identity before granting you access to information or acting on your request to exercise your rights. We may require you to provide information sufficient to allow us to reasonably verify you are the person about whom we collected personal information or an authorized representative and to describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We may limit our response to your exercise of the above rights as permitted under applicable law.
Agent Authorization
You may designate an authorized agent to make a request on your behalf. You may make such a designation by providing the agent with written permission to act on your behalf. As permitted by law, we may require additional verification in response to a request even if you choose to use an agent. You may also make a verifiable consumer request on behalf of your minor child.
Appeal Process
Some State’s law permits you to proceed appeal process in case your request has denied by us. In case we cannot wholly or partially comply with your request, the response we provide will explain the basis for our decision as well as the descriptions of your right to appeal and the manner you can exercise a right to appeal.
8. No discrimination for exercising your rights
We will not discriminate against you because of your exercise of any of the above rights, or any other rights under the applicable law, including by:

9. Processing of children’s personal information
With respect to a child’s personal information, we will obtain opt-in consent from statutory agents, such as a person with parental authority over that child, and take other necessary steps in accordance with applicable laws and regulations.
We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization or opt-in from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. 10. Security
We have established a management system pertaining to personal information protection and appropriately take organizational, physical, and technical safety management measures in order to prevent unauthorized access to personal information, prevent personal information loss, destruction, tampering, leakage, and the like, and otherwise to safely manage personal information. Also, we are aware of the importance of personal information protection and appropriately take personal safety management measures, which includes making efforts to provide educational and awareness campaigns regarding personal information protection for officers, employees, and the like who process personal information.

- (i) Right to delete
You have the right to request that we delete personal information about you which we have collected from you. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

- Comply with Yamaha’s ability to make repairs covered under warranty or communicate recalls to consumers.

You have a right to request correction of inaccurate personal information and we are obligated to use commercially reasonable efforts to correct the inaccurate personal information, as directed by the consumer.
